REFERRAL PRIVACY POLICY

Bardavon Health Innovations®; Inc. (“Bardavon®,” “we,” “us,” or “our”) owns and operates the referral page within bardavon.com (the “Referral Site”). The following is information about our policy on the collection, use and disclosure of the personally identifiable information that you provide to us and that we collect from you when you use the Referral Site (“Personal Information”), and your choices regarding the use and sharing of that information. We will not use or share Personal Information with anyone except as described in this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Personal Information

The privacy of the Personal Information that you provide to us is extremely important to us. The purpose of our Privacy Policy is to inform you about how we collect, use, disclose and protect the Personal Information that you provide to us through the Referral Site. We encourage you to read the Privacy Policy in its entirety.

How You Accept These Terms and Conditions of Use

By clicking “I Agree” and “Submit Referral” and by using the Referral Site you agree to the collection and use of the Personal Information you provide through the Referral Site. If you do not agree to be bound by and comply with the Privacy Policy, you may not submit any Personal Information to us through our Referral Site.

When you submit Personal Information to us through the Referral Site, you are representing and warranting to us that you have the authority to disclose that Personal Information to us through the Referral Site. If you do not have the authority to do so, you may not submit Personal Information to us through our Referral Site. You release us, our members, managers, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with your unauthorized submission of Personal Information to us.

Personal Information We Collect From You and How We Use and Share It

Our Internal Uses

The Personal Information that you may submit to us through the Referral Site includes personally identifiable information about a workers’ compensation patient, including demographic information, date of birth, and information about the injury, such as date of injury, body part affected, along with applicable prescription and other referral documentation (“Patient Information”), and personally identifiable information about yourself, as the referring adjuster or case manager, as well as personally identifiable information about the referring physician (“PII”). References to Personal Information include both Patient Information and PII unless otherwise stated.

We use the Patient Information to fulfill your request to refer a workers’ compensation patient case to us for referral to one of our network therapy providers. To do so, we review and analyze the Patient Information to determine which of our network therapy providers is best suited to provide therapy services to the patient.

We use the PII you provide about yourself, including your email address, phone number and fax number, to contact you to obtain any additional information that we may need or to provide you with information about your requested referral. By providing your email address to us and agreeing to the terms of this Privacy Policy, you are consenting to allow us to communicate with you by email. If you do not wish us to communicate with you by email, please contact us to make alternative contact arrangements.

We use the PII of the referring physician to contact that physician to obtain additional information that we may need to process your request for a referral.

We use Personal Information as necessary to administer the Referral Site. We do not use Personal Information for marketing, advertising or any purpose not related to providing the Referral Site and not described in this Privacy Policy.

Sharing Personal Information

We may share the Patient Information with our network of therapy providers to help us to identify the provider best suited to provide therapy services to the patient. We do not further share the Patient Information. We do not share your PII or the PII of the referring physician except as described in this Privacy Policy.

We share the Personal Information you provide to the Referral Site with other of our third party service providers as necessary to provide services to help us to provide and administer the Referral Site and to increase the Referral Site’s functionality. Our contracts with these service providers obligate them to only use and share Personal Information for these purposes.

We will disclose Personal Information where required to do so by law, including pursuant to subpoena and otherwise if we believe that disclosure is necessary to comply with the law. We will disclose Personal Information upon the request of law enforcement or to protect the security or integrity of the Referral Site if we believe that disclosure is required or authorized by applicable law.

If Bardavon is involved in a merger, acquisition or asset sale, Personal Information may be transferred as part of that transaction.

We do not share Personal Information with any other third parties except as described in this Privacy Policy. We do not sell Personal Information, nor do we share or disclose Personal Information to any third parties for any marketing or advertising purposes.

California

Pursuant to California Civil Code Section 1798.83, California residents have the right to request from a business any personal information that a business may have shared with a third party for direct marketing purposes. We do not share Personal Information with any third party for direct marketing purposes.

The California Online Privacy Protection Act (CalOPPA) requires us to disclose how we respond to Do Not Track signals set in a user’s browser. We do not collect “cookies” that would allow us to track you.

Security of Personal Information

The security of the Personal Information that you provide to us through the Referral Site is important to us, and we implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

The Referral Site is Hyper Text Transfer Protocol Secure (HTTPS). HTTPS is the protocol over which data is sent between your browser and the Referral Site and the “S” stands for ‘Secure’ meaning that all communications between your browser and the Referral Site are encrypted.

We use commercially reasonable efforts to keep the Referral Site and Personal Information safe and secure, but you are still using the Referral Site at your own risk. There is no guarantee that the Referral Site is 100% safe and secure. We are not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.

Changes to This Privacy Policy

This Privacy Policy is effective as of 12/1/2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on the Referral Site. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. We will post the effective date of the current Privacy Policy so that you will have notice of changes. The changes to the Privacy Policy will apply to all of the Personal Information that we have collected from you on the Referral Site. Your continued use of the Platform after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

Information Safeguards

Bardavon Health Innovations, Inc. is committed to safeguarding the Personal Information we receive from our customers and healthcare providers. We impose strict standards to maintain the confidentiality of Personal Information and we use physical, technical, and administrative safeguards to protect it. Our policies prohibit the unlawful disclosure of Personal Information. We share it externally only where federal and state law allows or requires it. Internally, it is our policy to limit the access, use, and disclosure of Personal Information to be in line with the job duties of our employees, as well as applicable law.

Information We Collect

Bardavon may receive information about you such as:

  • Your name, phone number, and postal address;
  • Your date of birth, social security number, and government issued photo identification; and
  • Your health and medical records details, including policy numbers or health insurance enrollee identification numbers.

We collect personal information from:

  • Insurance companies contracted with us;
  • Third Party Administrators contracted with us;
  • Government Agencies contracted with us;
  • Other insurance support organizations contracted with us; and
  • Healthcare providers contracted with us.

Information we collect from our customers and healthcare providers may be kept by them. Our customers and healthcare providers may disclose it to others.

Information We Disclose

We do not disclose personal information, except as required or allowed by law. Sometimes we are allowed to disclose personal information without consent.

Examples of such disclosures include:

  • To insurers or agents who provide us your Personal Information so we can perform healthcare and insurance functions;
  • To medical providers entitled to access your treatment plan;
  • To insurance regulators;
  • To law enforcement;
  • In response to subpoenas, search warrants, or other court orders; and
  • To contracted vendors and service providers who are bound to safeguard your Personal Information.

Bardavon employees, contractors, and vendors do not share confidential or proprietary information with anyone in or outside of the company, unless there is a valid business need and the employee, contractor, or vendor has received permission to do so.

Right to Review & Correct Personal Information

You may have rights regarding your Personal Information, subject to state or federal law. You may be entitled to review any Personal Information in our possession, request a copy of records containing your Personal Information, or request that any Personal Information stored by us be deleted.

The correspondence should include your name, address, phone number, policy, claim, or member number and describe the records that you would like to review. If we are able to complete your request, we may need to verify your identity prior to proceeding with your request.

California Residents

If you are a California resident, California law entitles you to request information concerning whether your personal information has been disclosed to nonaffiliated third parties for their direct marketing purposes. We do not share your Personal Information with nonaffiliated third parties for such purposes.

Australian Residents

We may disclose your personal information to our related bodies corporate, third party suppliers, service providers and other trusted third parties who may be located (or have facilities located) outside Australia, for some of the purposes listed above and otherwise in the ordinary course of business. The countries in which these organisations are located will depend on the circumstances. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations applicable to your personal information. We also use data hosting companies and other IT service providers which means your personal information may be transferred to and stored on servers in various locations both in and outside of Australia, including, but not limited to, the United States.
